<p>Minutes of BOA Meeting<br />
April 10, 2012</p>
<p>Chairman Dennis M. Robson called the meeting to order at 6:03 pm.</p>
<p>In attendance were Chairman Dennis M. Robson, Vice Chairman Ms. Lisa M. Flaherty, Member Charles Wehner, Assistant Assessor/Appraiser Ms. Debra J. Krupczak, and taking minutes Administrative Assistant Ms. Denice R. Alexander.</p>
<p>A motion was made by Chairman Robson to approve the March 20, 2012 meeting minutes. Member Charles Wehner 2nd the motion. All in favor.</p>
<p>A motion was made by Chairman Robson to approve &amp; sign monthly bills from Verizon for $32.80, Norfolk Suffolk Counties Assessors Association for $25.00, and Postmaster for 200.00. Signed.</p>
<p>A motion was made by Chairman Robson to approve &amp; sign March 2012 end of the month reports for Motor Vehicle Abatements for FY 2010 $55.62, FY 2011 $890.21, and FY 2012 $5,519.69 for a total of $6,465.52. Signed.</p>
<p>A motion was made by Chairman Robson to approve &amp; sign the FY 2011-8 Motor Vehicle Commitment Warrants for $255.00. The motion was 2nd by Member Charles Wehner. All in favor. Signed</p>
<p>A motion was made by Chairman Robson to approve &amp; sign the FY 2012-2 Motor Vehicle Commitment Warrants for $175,039.83. The motion was 2nd by Member Charles Wehner. All in favor. Signed</p>
<p>The Board approved &amp; signed the March 2012 end of the month reports for Real Estate Abatements / Exemptions totaling $11,835.96. Signed.</p>
<p>A motion was made by Chairman Robson to approve &amp; sign the Sewer Betterment Payoff Warrant for 4 Phillips Street for $109.21. The motion was 2nd by Member Charles Wehner. All in favor. Signed</p>

<p>• Assessor Krupczak updated the BOA on the new counter for the Assessors’ office to be built by the South Shore Voc. Assessor Krupczak suggested that the floors be cleaned prior to the counter installation. Chairman Robson said he would look into the possibility of floor cleaning during school vacation time.</p>
<p>• Assessor Krupczak updated the BOA on the Assessors’’ Map update status. She is continuing to proof the completed maps for accuracy and sending them back to Rob Rosa for updates as necessary.</p>
<p>Unfinished Business:<br />
• ATB Cases were tabled for the next BOA meeting on Thursday, April 19, 2012</p>
<p>The BOA will meet on Thursday, April 19, 2012 @ 6pm. Assessor Krupczak will send reminders to the Board.</p>

<p>Minutes of BOA Meeting - March 20, 2012</p>
<p>Chairman Dennis M. Robson called the meeting to order at 6:01pm.</p>
<p>In attendance were Chairman Dennis M. Robson, Member Charles Wehner, Assistant Assessor/Appraiser Ms. Debra J. Krupczak, and taking minutes Administrative Assistant Ms. Delshaune Flipp.</p>
<p>A motion was made by Chairman Robson to accept the February 13, 2012 meeting minutes. The motion was 2nd by Member Charles Wehner. All in favor.</p>
<p>Chairman Robson motioned to approve and sign sundries bills from Verizon, Plymouth County Registry of deeds totaling $489.99 and bills from WB Mason Totaling $42.08. The motion was 2nd by Member Charles Wehner. All in favor.</p>
<p>A motion was made by Chairman Robson to approve and sign the Chapter 61A Agricultural Chapter Land applications for Fiscal Year 2012 for Louise McCarthy, Map 82 Parcel 16, Wayne DelPrete, Map 68 Parcel 4 and Gerald DelPrete, Map 63 Parcel 109.</p>
<p>A motion was made by Chairman Robson to approve February 2012 Motor Vehicle Abatements, 2011 -$1,360.62 and 2012-$5,593.76, totaling $6,954.38. Member Charles Wehner 2n the motion. All in<br />
favor.</p>
<p>The Board approved &amp; signed February 2012 end of the month reports for Real Estate Abatements / Exemptions totaling $5,366.66. The motion was 2nd by Member Charles Wehner. All in favor.</p>
<p>A motion was made by Chairman Robson to approve (3) Senior / Surviving Spouse Clause 17 Exemptions for $525.00. The motion was 2nd by Member Charles E. Wehner. All in favor.</p>

<p>New Business:</p>
<p>• Ms. Krupczak updated the Board regarding the Articles for Town Meetings she submitted to the Selectmen on behalf of the Board.<br />
• Ms. Krupczak updated the Board on her meeting with Paul Kapinos from P K &amp; Associates on the pending fiscal year 2010 and 2011 ATB cases with Maple Realty Trust.<br />
• Ms. Krupczak brought to the attention of the Board that the Plymouth Registry of Deeds has charged us for the Tri-Town Deeds totaling $432.50 and if there are any changes to these deeds in the future we will continue to be charged a fee per a deed. Ms. Krupczak asked the Board if we could print the deed ourselves since we have access through their web site going forward. The Board approved her request and Chairman Robson will look into getting reimbursed from Tri Town for that fee.<br />
• Ms. Krupczak informed the Board that Pk Valuation Group will be starting year one of the Cyclical Inspection Program in the late Spring.<br />
• Ms. Krupczak updated the Board on the Real Estate &amp; Personal Property Abatement applications and presented the following applications for denial and abatement.</p>

<p> The Trust for Public Land Officials on behalf of Rockland Golf Course came before the BOA regarding the Fiscal Year 2012 property assessment and their subsequently filed abatement application. In attendance were Jeffrey Dugas, Appraiser, Lauren Butler, Attorney and Chris LaPointe, Management. Mr. Dugas conducted a presentation to the Board regarding an appraisal he completed for the Trust for Public Land. He will email Ms. Krupczak more detailed information for her to research and review.</p>
<p>New Business continued:</p>
<ul>
<li>  A motion was made by Chairman Robson on the recommendation of Assessor Krupczak to support and sign the Property Abatement Request Letter to the State (8 of 58) for R &amp; C Development, Inc. for fiscal year 2011 overvaluation of map 20 parcel 16 that should have been assessed as part of the common land for Rockland Glen Condominiums; motion was 2nd by Member Charles Wehner. All in favor. Signed.</li>
<li>  As per their request at the last meeting, Assessor Krupczak presented a draft letter for the Board’s review addressed to the Town Accountant regarding the preliminary tax adjustment policy that the Board adopted at the January 25, 2012 meeting. Chairman Robson and Member Wehner approved the letter. Assessor Krupczak said she would email the letter to Vice Chairman Flaherty.</li>
<li>  Assessor Krupczak informed the Board that she had drafted Annual Town Meeting Articles for the Boards’ review and approval. The first article was for $20,000 for fiscal year 2013 interim year appraisal services. The second was for $20,000 for year two of the cyclical review.
<p>The Board agreed to table the discussion on Fiscal Year 2013 Interim year funds until the next BOA meeting.</p>

<li>  The third article was to increase the Clause 41C Exemption from $500 to $1000 for qualified seniors. Assessor Krupczak polled several neighboring communities and found many of them had already approved an increase. It was her recommendation, in light of the increasing tax rate due to debt exclusions projects already approved and those that would come before Town Meeting in the spring, that this was a way to help those qualified seniors living on a fixed budget.
<p>After discussing the recommendation, a motion was made by Chairman Robson to approve an increase to the 41C Personal Exemption from $500 to $1000 for qualified seniors; motion was 2nd by Member Charles Wehner. All in favor.</li>
<li>  Assessor Krupczak briefly discussed the Overlay Account with the Board. The Board agreed to revisit the Overlay Account at a future meeting before Annual Town Meeting.</li>
<li>  The BOA will tentatively meet on March 13, 2012 @ 6pm. Assessor Krupczak will send reminders to the Board.</li>
<li>  Chairman Robson motioned to adjourn the meeting at 7:12 pm. The motion was 2nd by Member Charles Wehner. All in favor.

<p> Ms. Krupczak informed the Board that they will be receiving, for their review and input, a copy of the Board of Assessors report which will be part of the Annual Town Report.</p>
<p> Ms. Krupczak asked the Board if they would consider sponsoring an article for Town Meeting that would raise the Clause 41C exemption amount from $500.00 to $1,000.00. Chairman Lisa Flaherty suggested that we poll neighboring communities to see what they are offering. The Board table further discussion until the next meeting</p>
<p> Ms. Krupczak updated the Board on the Real Estate &amp; Personal Property Abatement applications received to date (deadline February 1) and presented the following applications for denial and abatement.</p>

<p> Ms. Krupczak updated the board on a meeting she attended with Town Accountant Eric Hart and Town Collector Judy Hartigan that was called by Town Administrator Allan Chiocca to discuss the procedure for adjusting the tax rate on the preliminary bill. According to Mr. Chiocca and Mr. Hart the call to adjust the preliminary tax rate is the Assessors.</p>
<p>For fiscal year 2012 no adjustment was made to the preliminary tax rate. The Assessors were not informed prior to the preliminary commitment to the Collector that there would be a large increase to the tax rate for the first year bond repayment for the Middle School debt exclusion. Therefore, the Actual tax bill (3rd &amp; 4th quarter) was hit with a large tax rate increase retroactive to the beginning of the fiscal year. Ms. Krupczak advised the Board that she would like to see an annual policy put in place that would address whether or not to adjust the preliminary tax rate.</p>
<p>Vice Chair Lisa Flaherty made a motion to propose a policy that going forward the Board of Assessors shall request that the Town Accountant either inform the Board of Assessors in writing, or attend a BOA meeting prior to May 15 to inform them of any debt exclusion or override information that will impact the tax rate for the next fiscal year. The motion was 2nd by Chairman Robson. All in favor.</p>
<p>Ms. Krupczak will send a letter to the Town Accountant explaining the new policy.</p>
<p> Ms. Krupczak informed the Board that Christopher LaPointe of the Trust for Public Land has requested an appointment at the next Board of Assessors meeting to discuss the assessed value of the Rockland Golf Course. Ms. Krupczak will contact them to set up a time at the next meeting.</p>
<p> Ms. Krupczak brought before the Board a Fiscal Year 2011 ATB case for 18 Tanglewood Dr. A motion was made by Chairman Robson to accept Ms. Krupczak recommendation to adjust the FY 2011 assessment of 18 Tanglewood Dr. from $357,200.00 to $341,000.00 resulting in an abatement of $240.89. The motion was 2nd by Vice Chair Lisa Flaherty. All in favor.</p>
<p>Old Business:</p>
<p> Ms. Krupczak reminded the Board about the Conflict of Interest Law online test and asked the members to complete, sign the last page and submit it to the Town Clerk.</p>

<p>Monthly sundries were signed for: Verizon, WB Mason, and Plymouth County Registry of Deeds for a total of $546.96.</p>
<p>A motion was made by Chairman Robson to approve the revised October end of the month report for Motor Vehicle Abatements for FY 2004 $43.75, FY 2009 $77.50, and 2011 $2,562.17 for a total of $2,683.42. The motion was 2nd by Member Charles E. Wehner. All in favor. Signed.</p>
<p>A motion was made by Chairman Robson to approve November end of the month report for Motor Vehicle Abatements for FY 2010 $279.16, and FY 2011 $4,891.18 for a total of $5,170.34. The motion was 2nd by Member Charles E. Wehner. All in favor. Signed.</p>

<p>The Town Administrator Allan Chiocca came before the BOA regarding the Beech St. Solar Energy Project. After discussions Chairman Robson motioned to approve and sign to waive all personal property tax for NEX Sun Solar. The motion was 2nd by Member Charles E. Wehner. All in favor.</p>
<p>Assessors updates:</p>
<p>Assistant Assessor/Appraiser Ms. Debra J. Krupczak discussed the changing of office hours to accommodate taxpayers in the evening, especially during tax season. The Assessor’s office will continue to stay open late two Mondays per month and discussions are still open to set a schedule.</p>
<p>New Business:</p>
<p>Assistant Assessor/Appraiser Ms. Debra J. Krupczak discussed FY 2013 budget updates: Recommended Online Property Cards $2,500 for FY 2013</p>
<p>Total proposed Budget for FY 13 is $146,951</p>
<p>A motion was made by Chairman Robson to certify Ms. Denice R. Alexander to certify Abutter Lists. The motion was 2nd by Member Charles E. Wehner. All in favor.</p>
<p>Ms. Krupczak will send reminders to the Board regarding next BOA meeting time.</p>

<p>A motion was made by Chairman Robson to accept the November 8, 2011 meeting minutes. Vice Chairman Flaherty 2nd. All in favor.</p>
<p>Assessors updates:<br />
Ms. Krupczak discussed the dealings of the exemptions with the collector’s office through Munis. Ms. Krupczak informed the board that there are 38 residential I &amp; E penalties totaling $1,900 and 98 Commercial penalties totaling $24,500.<br />
Annual Classification Hearing Packet was presented to the BOA. Classification hearing will be presented on November 21, 2011 @ 7:30pm.</p>
<p>Recommendations to Selectmen for Classification Hearing:</p>
<p>A motion was made by Chairman Robson not to recommend a residential exemption. Vice Chairman Flaherty 2nd. All in favor.</p>
<p>A motion was made by Chairman Robson not to recommend the small business exemption. Vice Chairman Flaherty 2nd. All in favor.</p>
<p>A motion was made by Chairman Robson to recommend a Residential Factor recommendation of 1 for 2012.Vice Chairman Flaherty 2nd. All in favor.</p>

Kathleen Flaherty’s retroactive surviving spouse of a disabled veteran, clause 22D exemptions for FY 2009, 2010 &amp; 2011 were signed Chairman Robson and Mr. Wehner totaling $6,821.53.</p>
<p>The Board of Assessors joined the Board of Selectmen at 7:30pm to attend the Annual Classification Hearing.</p>
<p>Next BOA meeting is scheduled for Monday, December 12, @ 6:00pm. Ms. Krupczak will send reminders to Board next month.</p>

November 8, 2011</p>
<p>Chairman Dennis M. Robson called the meeting to order at 5:45pm.</p>
<p>In attendance were Chairman Dennis M. Robson, Vice Chairman Ms. Lisa M. Flaherty, Assistant<br />
Assessor/Appraiser Ms. Debra J. Krupczak and taking minutes Administrative Assistant<br />

<p>A motion was made by Chairman Robson to accept the October 12, 2011 meeting minutes. The motion was 2nd by Vice Chairman Flaherty. All in favor.</p>
<p>Chairman Robson motioned to approve and sign sundries bills from Verizon, and Plymouth County Registry of deeds totaling $58.76. Vice Chairman Flaherty 2nd the motion. All in favor. Signed</p>

<p>A motion was made by Chairman Robson to approve October 2011 Real Estate Abatements for Fiscal Year 2011 totaling $1,278.82. Vice Chairman Flaherty 2nd the motion. All in favor.</p>
<p>A motion was made by Chairman Robson to accept the September 13, 2011 meeting minutes. The motion was 2nd by Member Wehner. Mr. Robson and Mr. Wehner voted in favor. Ms. Flaherty abstained from voting as she was not present at the September 13 meeting.</p>
<p>New Business:</p>
<p>• Assistant Assessor Krupczak gave the board members the LA 4 for all to sign.<br />
• Ms. Krupczak updated the board on the office progression and confirmed that she received final certification of valuations from the DOR on November 1 The classification date is set for November 21, 2011.<br />
• Ms. Krupczak handed out the summary of the Conflict of Interest Law to all Board Members and explained the online process and to sign last page so she can submit to Town Clerk.<br />
• Chairman Robson updated the Board on the Ethics meeting he attended on October 26, 2011 adding spread sheets to minutes and the meeting Agenda for convenience.<br />
• Ms. Krupczak brought four (4) Real Estate exemption applications to the board’s attention due to over- income therefore not meeting the requirements to receive the exemptions. Chairman Robson motioned to deny all four (4) applications due to be over- income. Member Wehner 2nd. All in favor.</p>
<p>New Business Continued:</p>
<p>• Chairman Robson motioned to approve and sign 13 Clause 17 D Real Estate exemptions totaling $2,275.00. The motion was 2nd by Vice Chairman Flaherty. All in favor.<br />
• Chairman Robson motioned to approve and sign 97 Clause 22 Real Estate exemptions totaling $38,800.00. The motion was 2nd by Vice Chairman Flaherty. All in favor.<br />
• Chairman Robson motioned to approve and sign 22 Clause 22 E Real Estate exemptions totaling $22,000.00. The motion was 2nd by Vice Chairman Flaherty. All in favor.<br />
• Chairman Robson motioned to approve and sign 10 Clause 37 Real Estate exemptions totaling $4,375.00. The motion was 2nd by Member Wehner. All in favor.<br />
• Chairman Robson motioned to approve and sign 36 Clause 41 C Real Estate exemptions totaling $18,000.00. The motion was 2nd by Member Wehner. All in favor.<br />
• Assistant Assessor Krupczak explained to the board that Rockland has a Taxpayer that applied and qualifies for the Clause 22 D Exemption. The Clause 22D Disabled Veteran Exemption is a full tax abatement in the first five year of eligibility and $2500 yearly thereafter. Ms. Krupczak has been in contact with an attorney from the state who verified that the Mrs. Kathleen Flaherty does qualify for this exemption and asked the Board to vote a retroactive exemption for fiscal years 2009, 2010 &amp; 2011 less $1,000.00 that was already approved under 22E as well as a full tax exemption for fiscal year 2012. Chairman Robson motioned that the taxpayer be granted the exemptions for previous years 2009, 2010, 2011and current fiscal year 2012. Member Wehner 2nd the motion. Mr. Robson and Mr. Wehner voted in favor. Vice Chairman Flaherty recused herself from discussion and abstained from voting.</p>
<p>Old Business:</p>
<p>• Assistant Assessor Krupczak informed the board that the Assessor’s office has been opened on the same night as Board of Selectmen meetings until 7:30 pm to accommodate taxpayers. She also advised the Assessors that she had spoken to the RITE Union representative and informed her of the new policy.</p>
<p>Ms. Krupczak notified the board that she received correspondence from New Cingular regarding a potential ATB settlement. They proposed an abatement of $5221.86 for fiscal year 2011 and in return they agreed to withdraw all 10 ATB cases dating back to fiscal year 2004.Ms. Krupczak recommended.</p>
<p>Chairman Robson motioned to accept the New Cingular Wireless settlement abatement totaling $5,221.96 for Fiscal Year 2011. Member Wehner 2nd the motion. Mr. Robson and Mr. Wehner voted in favor. Vice Chairman Flaherty abstained from voting.</p>
<p>The Board voted to adjourn the meeting at 6:27pm. Vice Chairman Flaherty 2nd the motion. All in favor.</p>

<p>Chairman Robson motioned to approve and sign sundries bills from Verizon, and Norfolk Suffolk Counties Assessors Association totaling $57.13.  Vice Chairman Flaherty 2<sup>nd</sup>.  All in favor. Signed</p>
<p>&nbsp;</p>
<p>A motion was made by Chairman Robson to approve September 2011 Motor Vehicle Abatements, 2010-$121.88 and 2011-$1731.36, totaling $1,853.24.  Vice Chairman Flaherty 2<sup>nd</sup>.  All in favor.</p>
<p>&nbsp;</p>
<p>A motion was made by Chairman Robson to approve September 2011 Real Estate Abatements for Fiscal Year 2011 totaling $6,142.14. Vice Chairman Flaherty 2<sup>nd</sup>. All in favor.</p>
<p>&nbsp;</p>
<p>Chairman Robson motioned to accept Schedule of Uncollectible excise for Fiscal Year 2004 Motor Vehicle excise $98.18  and Fiscal Year 2011 Motor Vehicle excise for $916.42.  Vice Chairman Flaherty 2<sup>nd</sup>.  All in favor.</p>

<p>Assessors updates:</p>
<ul>
<li>Assistant Assessor Krupczak mentioned adding BOA Members Vice Chairman Lisa M. Flaherty and Board Member Mr. Charles E. Wehner to the 2012 MAAO invoice.</li>
<li>Ms. Krupczak mentioned estimated new growth as of this date is $307,094.</li>
<li>Discussed increasing the 41C senior property tax exemption.  Ms. Krupczak would like to have this brought up as an article at the next Annual Town Meeting.</li>
<li>Changing Assessors’ Office hours was discussed to allow for convenience to Rockland tax payers.   Chairman Robson motioned to stay open Monday evenings to allow taxpayers to transact business in the evening, after their regular working day. Proposed hours are Monday 8:30-7:30pm, Tuesday-Thursday 8:30-4:30pm, and Friday 8:30-12:30pm. Vice Chairman Flaherty 2<sup>nd</sup>. All in favor.  Ms. Krupczak stated that she would look into the logistics.  Vice Chairman Flaherty was in agreement and recommended that we start after November 1. Chairman Robson agreed and suggested keeping the schedule consistent with the same evening that the BOS meet, being Monday evenings. Chairman Robson also suggested that the new hours be placed on the town website.</li>
<li>Assistant Assessor Krupczak mentioned it was suggested that there should be a representative from the BOA present at the Wednesday, October 26, (6:30pm) “Conflict of Interest” meeting.  She will email the board members with more details.</li>
</ul>

<p>New Business:</p>
<ul>
<li>The Release and Waiver to settle the 2011 ATB case for JBM Enterprises, Shaun K. Mahoney, was presented to the Board.  Chairman Robson motioned to reduce the property value from 920,500 to 834,500.  Ms. Flaherty 2<sup>nd</sup>.  All in favor.</li>
</ul>

<p>Old Business:</p>
<ul>
<li>Assistant Assessor Krupczak mentioned she is expecting to receive more information on the New Cingular Wireless ATB settlement before moving forward.</li>
<li>Ms. Krupczak stated that out of 418 Income and Expense forms mailed, 227 were returned. A second notice was sent. A late penalty for the remaining I&amp;Es was discussed.</li>
</ul>
<p>&nbsp;</p>
<p>A motion to assess a $50.00 penalty lien on Apartment Building property owners and a $250.00 penalty lien on Commercial and Industrial property owners that did not return Income and Expense Statements in accordance with Section 38D of Chapter 59 of Massachusetts General Law. Vice Chairman Flaherty 2<sup>nd</sup>. All in favor.</p>

<p>Next BOA meeting is scheduled for Tuesday, November 8, @5:45pm. Ms. Krupczak will check with Mr. Charles Wehner and send reminders to Board next month.</p>

<p>Chairman Dennis Robson called the meeting to order at 6:00pm</p>
<p>&nbsp;</p>
<p>In attendance were Chairman Dennis M. Robson, Charles E. Wehner and Assistant Assessor/Appraiser Debra J. Krupczak.</p>
<p>&nbsp;</p>
<p>A motion was made by Mr. Robson to accept the August 9, 2011 meeting minutes. The motion was 2<sup>nd</sup> by Mr. Wehner. All in favor.</p>
<p>&nbsp;</p>
<p>Sundries bills from WB Mason, Plymouth County Registry of Deeds and Verizon for a total of $101.44 were signed.</p>
<p>&nbsp;</p>
<p>A motion was made by Mr. Robson to approve August Motor Vehicle Abatements for $4,445.71.  The motion was 2<sup>nd</sup> by Mr. Wehner.  All in favor.</p>
<p>&nbsp;</p>
<p>A motion was made by Mr. Robson to approve August Personal Property Abatements for $3,900.00. The motion was 2<sup>nd</sup> by Mr. Wehner. All in favor.</p>
<p>&nbsp;</p>
<p>Ms. Krupczak updated the Board on the following:</p>
<ul>
<li>Grace Sandell from the Department of Revenue began the Revaluation recertification review for fiscal year 2012 values. She was at Rockland Town Hall from August 30-September 2. If all goes well, Rockland should have preliminary certification in about 6 weeks. The Assessors were given street listings of the proposed FY12 Assessments for their review.</li>
<li>I&amp;E’s –The Assessors voted unanimously to postpone voting on penalty liens until a future meeting</li>
<li>99% of the improved parcels will have digital images on the FY12 field cards.</li>
<li>Ms. Krupczak would like the Board to think about the possibility of submitting an article at Fy13 Town Meeting to increase the 41C Senior Citizen Exemption.</li>
<li>New Cingular Wireless ATB Settlement- the Assessors voted unanimously to postpone to a future meeting.</li>
</ul>
<p>&nbsp;</p>
<p>Ms. Krupczak discussed 2 foreclosed properties: 81R Pleasant St (map 25 parcel 3) and 638 Market St (map 53 parcel 19). Mr. Robson made a motion to abate taxes for both for FY 2011 for 81 R Pleasant for $2,935.18 and 638 Market St for $2,749.46. Mr. Wehner 2<sup>nd</sup> the Motion. All in favor.</p>

<p>Next BOA meeting – Week of October 17-21.Ms. Krupczak will check with Ms. Flaherty on her availability and email Mr. Robson and Mr. Wehner.</p>
